  • Once your disabled child reaches the age of legal adulthood a guardianship is needed so the Court can appoint you as the surrogate decision maker.
  • Without a guardianship in place, parents have no authority to make decisions and fully communicate with physicians, financial institutions and accountants on behalf of their loved one.
  • The guardianship process involves filing a petition with the Court and a hearing to establish the incapacity and need for a guardian.
  • Reaching that decision requires a medical report from two independent physicians.
  • Once the judge signs the Order appointing a guardian and declaring a person incapacitated, the guardian has authority to communicate with medical professionals, financial representatives and accountants and can make decisions for their child
